桑兰案最新状态（2016/09/16）

从案卷看，桑兰方要 dismiss prejudice， 莫虎不同意，现在双方递交了动议，就此问题进行辩论。

好像与前面报道《桑兰要撤诉，刘同意，莫虎不从》没有进展。

前面曾提到， 根据桑兰律师6月6日给法院的信件，桑兰与被告 KS LIU 与HG LIU 已经达成协议，桑兰撤诉。
因此这一部分诉讼算是已经解决。一般来说，双方是应该有个书面协议，确定条款。

莫虎不愿撤诉的理由我本来想好奇的看看，但一见有30页，我就懒得看了。桑兰方的回应只有10页，我张贴如下：sanglan-docket-326.pdf 。

桑兰方辩论到：【He baldly disputes Plaintiff’s position that she desires to dismiss this action in order “cease spending money litigating claims recovery on which may not ultimately justify the legal fees and costs required to bring this action through trial,” (Mov. Br. at 11), instead hypothesizing that Plaintiff’s actual motive is to “avoid an adverse written decision holding that her claims against Mo were fabricated,” (Opp. Br. at 23). But this illogical argument merely serves to beg the question: how does Plaintiff’s Rule 41 motion avoid the potential for such a decision? Mo has repeatedly threatened to bring an action for malicious prosecution against Plaintiff, it is his right to do so, Plaintiff fully anticipates Mo will follow through on his threat, and no order issued by this Court can preclude Mo from bringing such an action. 】【Plaintiff does have valid claims; we know this because this Court told us so when it denied portions of Mo’s motion to dismiss the complaint in February 2014. The fact that, in light of the document discovery provided by Mo and the Liu Defendants, Plaintiff has made a determination that, on balance, the cost of continuing the litigation may not justify the fees incurred, has no bearing on whether the claims are valid and actionable. Further, the majority of the resources incurred by Mo -- or, more precisely, by the Liu Defendants, paying Mo’s fees -- since discovery was exchanged in mid-2014, including those incurred trying to compel Plaintiff’s attendance at a deposition while she suffered serious post-partum complications, as well as those incurred on multiple procedurally improper and substantively barren sanctions motions, are due to Mo’s own litigation strategy, which was of course geared towards forcing Plaintiff to expend resources. In light of this strategy, Mo’s complaints concerning expenses incurred rings somewhat hollow, especially when, until early 2016, these expenses were being paid for by the Liu Defendants.  】【Having already previously moved, on three (3) separate occasions, for sanctions in this matter, Mo must by now know that his informal request for sanctions in his opposition brief (at 27-32), does not meet the procedural requirements under the relevant rules. 】

从上面的文字看，桑兰称决定撤诉的原因是根据案件显示的证据、继续耗费律师费不值。而莫虎称桑兰是为了避免法庭做出一个对她不利的判决。莫虎似乎还提到要制裁，但桑兰方指出莫虎根本没有提交合乎程序的制裁动议。

The defendants motion to dismiss for lack of subject matter jurisdiction (Docket no. 34) should be denied. The defendants motion to dismiss for failure to state a claim (Docket no. 28) should be granted with regard to the plaintiffs claims for defamation against Mr. Mo and Ms. Liu, civil conspiracy, primafacie tort, promissory estoppel, intentional infliction of emotional distress, negligent infliction of emotional distress, and eight of her ten alleged breaches of fiduciary duty. The motion should granted with leave for the plaintiff to re-plead with regard to her claims for unjust enrichment, conversion, and breach of fiduciary duty based on misappropriation of funds. The motion should be denied with respect to the plaintiffs claim for breach of fiduciary duty based on the defendants unauthorized use of her likeness in 2008, for invasion of privacy, and for defamation against Mr. Liu. The defendants motion for sanctions (Docket no. 47) should be denied without prejudice to being reviewed when the extent to which sanctions are proper becomes clear. Mr. Huang informed that Sang Lan's doctors have not released her from the Hospital because of complications, unhealed wounds and extreme fluctuations of blood pressures and "blood sugar" (I am told the medical term is Pathoglycemia). The doctors need to closely monitor her blood pressure and "blood sugar" to prevent serious complications. Apparently, the wounds are a problem, according to her doctors. There is no significant recovery and she cannot meaningfully participate in discovery at this time. ENDORSEMENT: In light of the information contained in the May 1, 2014 letter of defendants' counsel, third-hand information is no longer sufficient. 03/31/2016310 MEMORANDUM AND ORDER: In a Memorandum and Order dated May 4, 2015, I awarded the defendants in this action $20,627.78 in attorneys' fees and $405.00 in expenses as a sanction for the plaintiff's failure to attend her deposition. (Memorandum and Order dated May 4, 2015 (Fee Assessment Order"). Recently, the plaintiff moved for reconsideration of the Fee Assessment Order. Because the time had long passed for seeking reconsideration, I construed the plaintiff's application as a motion for relief from an order on grounds of mistake or inadvertence pursuant to Rule 60(b)(1) of the Federal Rules of Civil Procedure. I then denied the motion in a Memorandum and Order dated March 16, 2016 ("Reconsideration Order"), in which I found that my calculations in the Fee Assessment Order were consistent with the methodology that I outlined there. The plaintiff has now filed objections to the Reconsideration Order. Because those objections reflect a misunderstanding of the Fee Assessment Order, clarification is appropriate. The plaintiff appears to believe that the only fees allowed under the Fee Assessment Order were those attributable to thirty percent of the time spent by defendants' counsel in deposition preparation. (Plaintiff's Rule 72(a) Objection to the March 16, 2016 Order of Magistrate Judge Francis Fixing the Fees and Costs Awarded Defendants ("Objections") at 1-2). That is not correct. I found that only thirty percent of the time devoted to deposition preparation would be compensated because that preparation would still be largely useful for the rescheduled deposition. (Fee Assessment Order at 3). However, there were a variety of other tasks that counsel performed in anticipation of the aborted deposition that were compensable in full, such as making logistical arrangements for the examination. (Fee Assessment Order at 9). Thus, I first separated compensable from non-compensable work, and then reduced to thirty percent the compensable work that related specifically to deposition preparation.
